Tree came snapped – only partial refund given

My review for thesill.com I ordered an olive tree as a sentimental gift for a family member. Upon arrival, the tree was snapped in half where the support rod ended. Almost every leaf on the tree has fallen off and it was basically bare. While I understand that some plants get stressed in shipping, this was excessive. I contacted the company by email and on the web page. The "live chat" listed on the website was non existent. I provided pictures of the tree and answered the question of whether the box had been damaged. About a week went by with no response, and when I finally did hear back, I was offered a medium size plant of a different kind as they were out of olive trees. They only offered a portion of the price I paid, and when I questioned why I was told that the pot wasn't damaged so they wouldn't be sending another one/refunding that portion. I had already explained that I didn't want another plant as it was only an olive tree that held the sentiment and just wanted the refund. What need do I have for a pot without the plant, and it was a gift (which I had stated repeatedly). There was no option to send the pot back. All they did was refund a portion of my money. Now I have no gift, and an expensive pot.
